Canadian citizenship and the 1095 days

Canadian citizenship and the 1095 daysCanadian citizenship and the 1095 days

In Canada, the only way for a foreign national to obtain Canadian citizenship is after permanent residence or if he/she marries or is in a common-law relationship and is sponsored by a Canadian citizen or permanent resident.

What is required to become a Canadian citizen?

To achieve this dream, there are several steps that we share with you below.

  1. The first is to obtain permanent residency, which you can do if you apply for any legal immigration program in the country, such as Express Entry, or if you marry a Canadian. Otherwise, you must start by becoming a temporary resident through a study or work visa and once you have experience as a worker or postgraduate in Canada, start applying for permanent residency.

At Immiland Canada, we always mention the importance of doing the application the right way, from the beginning, because we know that with permanent residency your life begins to change!

  1. The second step is the application for citizenship. Reaching this goal is wonderful because, in addition to the fact that you can have the same rights as a Canadian and vote in elections for prime minister, mayors or governors and even run for high government positions, it allows you to obtain the coveted passport and this offers you stability and exempts you from renewing documents to be legally in the country.

Permanent residency gives you freedoms, but don't make these mistakes!

The 1095 days

Being a permanent resident allows you to live in Canada or travel to another country on vacation, for work or business, etc., because this status gives you the freedom to do so, however, it also creates a permanent residency obligation, which indicates that in a period of 5 years since you are a permanent resident you are obliged to live in Canada for at least 1095 days, i.e. three years. Therefore, you must have lived in Canada for 3 of the last 5 years prior to application. This means that you can receive your residency and go to your country and stay there for 2 years.

The mistake lies in going beyond the 2 years and taking even one day out of the 3 year residency obligation, if you do so, you will automatically be in violation of the permanent residency obligation for 1095 days and can be revoked and lose your residency.

Of course there are exceptions to these 1095 days, if this is your case, you will require an immigration consultation to evaluate it in detail. Immiland Canada has immigration services and consultants regulated by the College of Immigration and Citizenship Consultants (CICC), you can visit our website for a consultation by clicking here.

Then, once you complete your period of time as a permanent resident, which is five years, you can apply for citizenship.

How does the citizenship process work?

  • You must have declared three years of taxes in Canada.
  • You must submit proof of your language skills (English or French intermediate speaking and listening level, equivalent to CLB 4 or IELTs 4.6). However, there are options to avoid the English test. For example, if you studied at a college or institute in Canada, it is already valid to waive the test and you only need to show your graduation certificate.

If you have already studied English or French, then you can eliminate the test requirement with your diploma.

  • Take the citizenship test. This exam lasts 30 minutes. It contains 20 questions, 15 of which must be answered correctly to pass, covering the history, geography, economy, government, laws and symbols of Canada. Nowadays the exam is taken online. The study guide is provided by the Canadian government and consists of 110 pages of study.
  • Once these steps are completed, you will attend a ceremony to take the oath before the king and then you will receive your citizenship certificate and apply for your passport.
