From undocumented in the U.S. to legal in Canada
Being in a foreign country without immigration papers that allow them to have a "legal" status, is the reality that thousands of Latinos face in some countries like the United States for example; many dream of living in a country where they feel safe and that achieving the long-desired permanent residency is a reality.
As a result, thousands of people are known to focus on migrating to Canada legally, which is known as "the new American dream".
However, how possible is it to migrate to Canada legally for people who are undocumented in other countries?
To answer this we must divide the options into 2 categories:
1. When applying for a temporary Canadian visa (work, study, tourism), immigration officials require that the person has a legal immigration status in the country where he/she resides. This is why when a person wishes to apply for a temporary visa without immigration status in a country, the visa becomes literally impossible to obtain. For this reason it is essential that the undocumented person evaluates the possibility of returning to his/her country of origin or going to another country where he/she can have a legal status and from there apply for the Canadian temporary visa.
This is a strategy that we have applied with many of our clients. And it has helped us to bring them to Canada.
In these cases the process is quite risky because there is no certainty that the decision to leave the country where one is illegal and go to another country like the country of origin will result in the approval of the visa. There is always a percentage of possibility of rejection of the Canadian visa.
Many undocumented immigrants ask themselves: Is it really worth it to remain undocumented in another country? Or to return to the country of origin and try everything there with the possibility of applying for a visa in Canada? And if approved, to try to make a life in Canada; it is a very difficult decision that only each person can make.
2. The second category deals with the cases in which the person applies for a permanent resident visa and if it is possible to do it directly from the country in which they are without documents. For this type of immigration process we can mention some options such as express entry, the Atlantic Immigration Program, among others. In these cases the application for permanent residency becomes somewhat more probable, assuming that people have the profile that these programs are looking for. However, in these situations the status of the person who is without documents does not make the candidate inadmissible to the immigration process.
