Is it possible to leave Canada with a work permit or PGWP application in progress? Is it possible to leave Canada with a work permit or PGWP application in progress?

A common uncertainty for many international students and/or temporary workers in Canada is whether or not they can travel abroad while waiting for their work permit extension or Post-Graduation Work Permit (PGWP) approval. The good news is that they can, but they should be aware that this comes with a number of situations that may arise.

Immigration procedures are complex and you must always be up to date to meet the requirements and understand the different scenarios. If you are waiting for an immigration process and have to leave Canada, read this topic to the end so you know what to do depending on your situation. Let's get started!

Different scenarios if you applied for an extension of your work permit

Can you travel outside of Canada? Yes, you can. Yes, you can leave Canada and return. However, three different scenarios can occur upon return:

  1. Entry as a visitor: If your extension has not yet been approved at the time of your return, you may be allowed to enter Canada as a visitor. In this case, you will not be able to work until you receive approval of the new work permit. The border officer may ask you to show that you have sufficient funds to support yourself in Canada.

  2. Entry as a worker: If your work permit was approved while you were away, the officer may allow you to enter as a worker. Be sure to bring your approval letter or access to your IRCC account to show evidence.

  3. Applying for a new permit at the border: There is also the possibility that the officer may ask you to apply for a new work permit at the time of entry. This can create complications, so it is advisable to avoid relying on this option.

In all cases, you must meet the general entry requirements and have a valid visa or eTA.

Can you travel outside Canada if you are waiting for the PGWP?

That's right! You can also leave Canada and return if your visa or eTA is valid. Remember that a study or work permit is not a visa and does not guarantee re-entry.

Depending on your situation, here's what may happen when you return:

  1. If your study permit is still valid, you may enter as a student.

  2. If your PGWP was approved while you were away, you may enter as a worker.

  3. If you applied for the PGWP while your study permit was in effect and the application is still in process, you can enter as a visitor and work without a work permit until a decision is made, thanks to the status maintained.

  4. If you applied for a PGWP extension because your passport expired and you left the country in maintained status, you may return as a visitor, but you will not be able to work until your new application is approved.

Important! Remember that, as of June 21, 2024, you can no longer apply for the PGWP at the border. you can no longer apply for the PGWP at the border.. You must apply before coming to Canada, or after you have entered as a visitor with a visa or eTA, if you are eligible.

What documents must be shown to the border official?

Upon arrival in Canada, an officer may ask you questions about your status and request proof that you submitted your permit application. We recommend that you bring:

  • A copy of your PGWP application or extension.
  • Proof of payment.
  • Any correspondence from IRCC.

If the officer considers that you do not meet the entry requirements, then you may be denied entry. In that case, we recommend request an appointment with Immiland to evaluate your options for re-entry with approval of your paperwork.

In short, traveling outside of Canada while waiting for a work permit or PGWP is possible, but you must be very well informed about your immigration status, carry the proper documentation and make sure you have a valid visa or eTA. Always assess the risks and consider speaking to an immigration consultant if you have questions about your specific case.
