How to identify if your job offer qualifies for Express Entry? 

One of the most common mistakes when calculating a person's score to apply for permanent residency in Canada is to consider that any job offer will add points to your profile regardless of the characteristics and conditions under which it has been issued; in most cases this is not the case. For a job offer to work in your favor, there are a series of requirements that must be met, here are the following:

  • The labor offer must be supported by a labor market impact assessment (LMA).Labor Market Impact Assessment or LMIA). This study is done with the objective of demonstrating that the employer could not find candidates in Canada capable of fulfilling the functions of the position and that, in addition, they were in agreement with the salary and general conditions of the position. 
  • If you are working in a NOC/TEER 0, 1, 2 or 3, i.e. in a skilled or high skilled position, and your employer already has a LMIA in place for your same position (i.e. they used it to bring in other workers with a similar profile to yours), your offer will be issued based on it as long as you have an offer from that employer of at least 1 year in addition to whether you are accepted as a permanent resident. 
  • If you have a valid work permit for a NOC/TEER 0, 1, 2 or 3 exempt from an LMIA (for example, if you are working in a position covered by a Free Trade Agreement with Canada, such as the CUSMA - Canada, USA and Mexico) and, in addition, have 1 year of experience working for that employer and a job offer of at least 1 year subsequent to the issuance of permanent residence. Not all work permits with the exception of the LMIA except for the LMIA (specifically open work permits) are valid to apply for your job offer points.

It is important to know that your job offer must comply with other general requirements such as: (i) indicate that it corresponds to a continuous period, that is, that it is not seasonal, and (ii) detail your functions. 

Without these requirements your job offer will not add points for your permanent residency process through the Express Entry system. Therefore, in order to make an efficient immigration plan, it is recommended to verify that your job offer complies with the above mentioned requirements and the rest of the specifications established by the Canadian government.
