Marriage by papers in Canada? 

One of the most typical ways to obtain permanent residency in Canada is through partner sponsorship. 

It is important to note that if the only reason for the relationship is to benefit from the immigration system, the application may be denied and this constitutes immediate immigration fraud. 

Here we tell you the particularities of this type of application: 

  • The application can be made inside or outside Canada,
  • If done outside of Canada it is important to demonstrate a solid and clear plan that once the couple obtains residency the life plan is to move to Canada, 
  • If applying within Canada, the applicant may obtain an open work permit prior to residency, 
  • This type of application does not give citizenship (passport),
  • The benefit of sponsorship is that the foreign partner becomes a permanent resident, 
  • The person sponsoring the application must be a Canadian or permanent resident, 
  • The parties do not necessarily have to be married, they can prove that they have lived together for at least 12 months. This is called a common law relationship,
  • Canada recognizes same-gender couples for sponsorship, 
  • The process can take up to 12 months, 

In many cases the sponsor may be declared ineligible for this process. 

Why? 

  • The sponsor was sponsored by a spouse or partner and became a permanent resident less than 5 years ago.
  • You are still financially responsible for a former spouse or partner that you sponsored. This means that you are still bound by the 3-year commitment to care for this person.
  • You are under 18 years of age. 
  • Is in jail, prison or penitentiary
  • Failed to repay an immigration loan
  • Failed to provide the financial support you agreed to when you signed a sponsorship agreement to sponsor another person in the past (not applicable if you live in Quebec).
  • Declared bankruptcy and is not discharged (not applicable if you live in Quebec).
  • Receiving social assistance for a reason other than a disability
  • Was convicted of attempting, threatening to commit or committing a violent criminal offence, any offence against a family member or any sexual offence in or out of Canada
  • You cannot legally remain in Canada and must leave the country because you have received a removal order.
