My name is Eddy Ramirez and I am a consultant regulated by the ICAC, in this Immiland article I am going to give you details about the new changes officially announced by Minister Marc Miller on January 22, 2024, as well as some aspects that are to be defined in the coming week, according to the words of Miller himself, all this with the intention of keeping you updated and waiting for new information. Here's what you need to know so far.

What are the changes?

The provinces must accept you as a student, which means that when you travel to study in Canada:

1. The school has to accept it.

2. The province must accept it. 

3. Canada must give you the study permit (You cannot skip these steps).

You must present an attestation, which means that the province approves your coming to Canada to study. 

What should you know about attestation?

If you come to the province of Quebec to study, you must present a CAQ, that is to say a letter of acceptance (attestation) that Quebec gives you to study, now, if you come to Canada in the next few days, you should know that the rest of the provinces do not yet know how this attestation will be. The Canadian government is saying that if you are going to travel to Canada to study, do not apply for your study permit unless you have this letter and also indicates that the date on which it will be issued is March 31, 2024, but this may not be the case if you are within the exceptions.

What are the exceptions?

Foreigners traveling to study are exempt:

1. A master's degree.

2. A PHD.

3. A postgraduate diploma. 

One positive thing is that postgraduate diplomas are done at the college level, so if you were admitted to a college to study a postgraduate diploma, then you can apply for your study permit now without waiting until March 31 and you will not need to apply for the permit in the province because you don't need it.

To what type of study do these changes apply?

To answer this question, let's start by defining what a postgraduate diploma is.

The postgraduate diploma is a study that requires a bachelor's degree and is below the master's degree, and is done at the collegiate level. 

However, in colleges there are two types of programs: the post secondary diploma and the post graduate diploma.

  1. Post secondary diploma: to apply for this type of study, which does not require a previous university study, unfortunately you have to wait for the province to accept you!
  2. Post graduate diploma: for this type of study, you can rest assured that you can apply for your visa right away. 

Remember that if you are coming to the province of Quebec to study and you have already applied to a CAQ, then you can rest assured that the province has been using this acceptance system for several years and that there are no changes in this regard.

And if you have not yet applied to your CAQ and are traveling to study a post secondary diploma or post graduate diploma, you can still apply without being affected.

What should you consider when applying for a student visa?

  • The first thing you should know is that if you travel to Canada as a single person you can apply without any problem, but the type of study must be in a public college , not a private one.
  • If you are traveling to Canada as a couple, you should take into account that as of the date this article has been written there is a process of interpretation to be done with what could happen, since the minister said that in the following weeks the student's partner will not be able to apply for an open work permit, but at this moment he has not said that you cannot, so until official information is issued on this matter there is a sort of legal vacuum, that is to say that you should be able to apply. In conclusion, if you are traveling to Canada with your partner, it is best to apply at once because maybe you are going to get into that grace period and you are going to be able to get your open work permit application approved or else your application is going to be returned.
