Risks of Hiring an Unregistered Educational Agency in Canada: When the "Use of Representative" Form Is Not Signed!

Applying for a study permit in Canada through educational agencies can be a good strategy if done correctly, but it can also be the worst decision if you fail to sign the official “Use of Representative” form.

‍

When you hire the services of an unregistered agency and do not sign this document, you run the risk of being accused of misrepresentation, which bars you from entering the country for five years and may render you inadmissible.

‍

In this article, I will describe the real-life case of a Latino applicant who made this mistake, triggering a series of complications in his immigration process.

‍

What exactly happened? Read along with me below and avoid making the same mistake.

‍

Case of Misrepresentation Due to Omission on the Form

The student hired an unregistered agency to help him apply for his student visa. He did so from his home country.

‍

The educational agency handled the process, but did not declare that it was using its services via the Use of Representative form (IMM 5476), which was required in this case.

‍

Omission of the " Use of Representative" Clause

This official form, known as the Representative Form or "Use of Rep," authorizes the (educational) advisor to act as the client's representative before Immigration, Refugees and Citizenship Canada (IRCC) and the Canada Border Services Agency (CBSA) in order to carry out the client's immigration process.

‍

By failing to fill out the form, the advisor acted without government authorization to apply for the study permit.

‍

In addition, during the process, there was a mix-up with the files, and the application submitted to Immigration was for another client; therefore, there was a discrepancy regarding the applicant.

‍

The immigration officer noted both errors: the omission of Form IMM 5476 and the submission of another person's file in the name of the applicant for a study permit.

‍

This discrepancy led to a charge of " misrepresentation, " which means providing false information or deceiving immigration authorities.

‍

Actions Taken by the Immigration Officer

For the immigration officer, if an applicant fails to mention that a third party was involved in preparing or submitting their application, or if they submit conflicting or erroneous documents, this is interpreted as an attempt to conceal information or misrepresent the facts of the case.

‍

If you do not sign the form, the authorities will detect it, and the direct consequence will be a 5-year ban from entering the country, which may even result in a permanent order.

‍

Mistakes to Avoid When Hiring an Agency

  • One of the biggest mistakes is choosing an agency simply because it charges lower fees than other companies or promises free services. Doing so carries the risk of neglecting quality standards and expert oversight in document handling.

‍

  • Confusing the role of an educational advisor with that of an immigration consultant or a Canadian lawyer. Guiding the applicant in choosing an institution and enrolling in a program is different from handling the legal process of obtaining a study permit.

‍

In these cases, legal representation must be authorized using the appropriate form.

‍

  • Leaving the process in the hands of third parties because you believe you cannot handle it on your own. Any applicant for a study permit can file the application on their own; however, if you have questions along the way, it is best to entrust the process to trained professionals, whether through a properly registered agency or an immigration consulting firm with certified and licensed attorneys and consultants.

‍

Recommendations on the Use of Rep

Here's what you need to know about the Use of Rep in case you decide to rely on a third party.

‍

  • The Use of Rep is the legal document submitted to Canadian authorities when a person pays an agent or even when they receive support from a third party without compensation.

‍

  • This form must be completed, carefully reviewed, and signed by both the applicant (the client) and the person or entity providing the intermediary service.

‍

  • Before hiring an educational agency, evaluate its reputation in the market. Prioritize experience over cost.

‍

  • It makes sense to work with third parties because they can help you find your way, but price shouldn't be the only factor. Hire agencies with experience and a proven track record that give you a sense of security through the information they provide—not through the false economy of their rates.

‍

  • If you're handling the process on your own and would like a second opinion, consider using a file review service to make sure everything is on the right track.

‍

Experience and transparency in handling your documents are the only tools that can safeguard your academic future abroad.

‍

If you decide to hire an agent, make sure they sign the form; otherwise, consider switching agencies.
