In early January 2026, together with my team at Immiland Law, I won a lawsuit against the Canada Border Services Agency (CBSA). Although it may sound unbelievable given that it is a government institution, it is real and possible.
Even in the darkest scenarios, such as unfair deportation, there is a legal way to rescue that Canadian dream.
In the words of a customer:
"Every small step you take shapes the path to achieving your goal."
This is very true and, moreover, sums up the success of thousands of foreigners who have faced bureaucratic obstacles, official errors, and legal setbacks before achieving it.
In this blog, I will share with you what can happen to an application during the process and how a rigorous legal strategy and unwavering defense of Canadian immigration law can make it possible to reverse mistakes made by the authorities.
In the Canadian system, the Canada Border Services Agency (CBSA) is the authority responsible for border surveillance and immigration law enforcement. The agency operates at ports of entry (airports and land borders).
Its officers work with thousands of applicants every day, and although they are trained for the job, they are human and as such can make serious mistakes, such as failing to comply with "Procedural Fairness " or misinterpreting the Immigration and Refugee Protection Act (IRPA).
When a foreigner is deported without solid justification or without being allowed to present their defense adequately, we are faced with a violation of rights.
Procedural fairness is an immigrant's right to be heard and to defend their case with truthful and accurate documentation.
As licensed Canadian lawyers, our role is to intervene through lawsuits or requests for review before the Federal Court to challenge arbitrary decisions.
In Canadian immigration law, there are mechanisms in place to correct injustices. By presenting arguments based on our client's profile and the correct submission of their documentation, we were able to get the CBSA to acknowledge and rectify their mistakes.
Important: Winning an immigration lawsuit is a complex legal process and requires experience and complete commitment to the person affected.
Only Canadian lawyers who are members of the bar have the legal authority to litigate these cases before the courts of Canada.
An independent advisor, a lawyer from your country of origin, or an influencer (even if they are familiar with the process) is NOT licensed to represent your defense in legal proceedings against a federal agency.
Although consultants handle applications, only attorneys can file lawsuits in federal court.
Just as we celebrate success stories, we also warn that these are only possible when the process is carried out correctly with the right professional help.
The path to residency is a battle of perseverance. It is won day by day through planning, improving your profile, managing documents, and maintaining your legal status.
When these steps are taken properly, we achieve the success stories that we celebrate so much at Immiland Law.
